Erika and Tom Girardi's legal trouble is continuing amid their divorce, and it's been revealed by close friends and family that the 81-year-old lawyer is struggling to maintain his health.
Legal papers were obtained by People which revealed that Tom's brother has filed for conservatorship, saying that his brother's mental health is deteriorating, making him unable to look after himself.

Real Housewives of Beverly Hills star Erika Girardi is in the midst of a messy divorce, and it would seem that her now-ex-husband, Tom Girardi, is struggling amid the battle.
In the citation for conservatorship that was obtained by People, it was said that Tom's brother, Robert Girardi, said that Tom is "unable to provide for his personal needs and unable to manage his financial resource."
A court hearing has been set for June 9, and if they find that Robert should be appointed Tom's conservator, Robert will end up deciding where Tom will live and have complete control over his estate and finances.
In the petition, it also stated that Tom has "sadly deteriorated to the point where he cannot care for himself without assistance."
"His short-term memory is severely compromised and, on information and belief, he is often not oriented as to date, time or place," it said.
It also added that Tom's housekeeper of 25 years is leaving his estate because he can't afford to pay her anymore.
"While Tom does have family members, such as Petitioner [Robert], and certain friends looking out for him to make sure he has sufficient food and that he makes it to a given appointment on time," the petition reads, "left to his own devices, it is highly doubtful that Tom could manage most of the activities of daily living for any significant period of time without assistance."
Erika has spoken with People previously about her decision to file for divorce back in November stating that it was not "a step taken lightly or easily."
In December, Tom's law firm, Girardi and Keese had all their assets frozen by a judge and were found to be held in civil contempt.
Also last month, Tom's partner hit him with another lawsuit claiming that he never paid him $315,000 in income, instead keeping that money for himself and taking out loans against their property without their knowledge for his "own personal gain, benefit and use."
Before any more court proceedings happen, Tom will be examined for his "mental competence" by a doctor. Erika has yet to speak anymore on her divorce.
